Not fishing related...

Hi

My wife got into an accident more than a year ago and tonight, we got a knock on the door. We were handed a Writ of Summons and that person is claiming for all kind if injuries like back pain, feet pain, leg pain, hand pain, insomnia and depression.



Can you believe from a small damage like that to our car???

Any advice as to what we should do now?

I'm not an expert but they sue your insurance I think, not you personally  ??? ??? ???

The Writ has her, my name and the Mercedes Benz( as this was a leased car ).

Should it not have ICBC's name too?

Should probably contact ICBC as insurance would cover these types of things I believe.

Thanks- I got it. It can be scary because we have always lead a quiet and honest life. To be sued can be an overwhelming experience!!!

I hear ya. If they had a legitimate case they would have sued you alot sooner than waiting til the statue of limitation runs out. (I believe it's one year) Seems to me that they're hoping for a financial windfall.

ICBC will handle all this for you, I was sued two years ago and ICBC just worked out a settlement, they just required a statement.

Yea. I had a similar thing happen a few years back. I gave a statement to ICBC at the time of the accident and had to talk to a lawyer one time that ICBC arranged and never heard another word after that.

CohoMan... sounds fishy, but I would let an ICBC agent handle it.
BUT, yes I can believe all that pain for a simple accident.
My aunty blew out her rotator cup in a simple rear-ender. The car was less damaged then that.
2 years later she still has extreme pain, 2 surgeries and hasn't been working, so yes all that damage is very possible from a small accident.

Fish Assassin - things can get worse as time goes on. They may not have had many problems at the beginning. If it all started in the foot or knee that can throw your whole body off and lead to the leg and back pain down the road.
