that sweater test is bogus and will not stand in court just like the old cotton ball test...i have spoken with DFO and i was informed that proper attempts must be met, to pinch barbed hooks as specified in the Regulations under the Ocean's and Fisheries act, but no where do they
suggest or
insist on filing down crimped barbs to prevent prosecution...apparently officers may not represent the agency in a manner which may sway or misguide the public beyond what is written under the act, regardless of good intent...unless specified as a
personal opinion, an officer may be reprimanded for misconduct.
so in Lamen's term if you buy a lure at Fred's on the day that you go fishing and then proceed to tightly pinch the barb on the hook... a fisheries officer can't go to you and say..."you didn't file the barb down, therefore i'm issuing you a ticket because a strand of wool pulled from the sweater"... that's going to the extreme when the regs have been followed to a tee...that's unfair and unconstitutional.
if they want to change the regs all they have to do is specify the use of a barbless hook by design to eliminate any discrepancy.
