FISH HABITAT -- still needs protection (tell your MP)
« on: March 15, 2012, 09:38:02 AM »

A very disturbing report indicates the Feds may be about to remove *Habitat Protection* from the Fisheries Act. See:

http://blogs.canada.com/2012/03/13/are-tories-secretly-rewriting-the-rules-on-protecting-fish-habitat/

If you read between the lines, you can see that they'd want to remove the word "habitat" from the Act in order to open the door wide for construction of things like pipelines. The proposed changes also add lots of woolly exemptions that would make enforcement of protection all but impossible. Will you, like me, write a courteous but firm message to your MP and to the Minister of Fisheries telling them these changes are wrong and completely unacceptable? Here's the minister's contact info:

The Honourable Keith Ashfield
House of Commons
Minister of Fisheries and Oceans
Parliament Buildings, Wellington Street
Ottawa, Ontario K1A 0A6

Over in the fisheries/news forum this thread is also talking about this..

I can't stress this enough - this is of paramount concern to fisherman. This will absolutely cripple the protections to our waterways. There will not be anything holding back industry from demolishing our watershedsif it can be demonstrated that they are not strongly contributing to an economically valuable fishery. The problem is obvious. The salmon fishery gets its strength from the joining of massive amounts of small systems, each of them individually has a small impact on the fishery, but as a whole they create the giant runs we see on the Fraser, Skeena, and other major systems. Each system is important, and if you start ruining all the smaller systems the implications will be there. I guarantee you, THIS CONCERNS YOU. TAKE A STAND.

We will lose our fish once and for all.

Bump.  You guys all fish obviously.  Fish need habitat.  This change to the Canada Fisheries Act threatens all fish bearing bodies of water in Canada.  Please write.

A decision that is categorically and fundamentally wrong. If anything we should be strengthening legislation that protects and enhances our fisheries and other natural resources. When will we learn to star caring more about things that matter most?

The BNN network channel just had a good interview with the Professor of Ecology from the University of Alberta, and he mentioned that they submitted a petition to the Government against the removal of the "habitat" clause.  Within a week, they had over 600 signatures.  He said that if they continue with the petition for another week, they will most likely reach 5000 signatures.

This is obviously a huge concerns for a lot of Canadian. Thank God.

The part that worries me most is the subsection mentioned in Jon5hill start up , following the new proposed section;

35(1) No person shall carry on any work, undertaking or activity, other than fishing, that results in an adverse effect on a fish of economic, cultural or ecological value.

Under the subsection 35 (2) No person contravenes subsection (1) if

under d)(d) the work, undertaking or activity is carried on in, on, over, under, through or across any Canadian fisheries waters, and

Doesn't that mean that just about anything goes, from bulldozer, 4X4, whatever else,

seems to me that this subsection really leaves a huge gray hole ;and allows everything under the sun to proceed with the Work ??? :'( ???

without any review or restrictions??????????????????????? ???
